General Duty
All owners / managers of a premises, including homeowners have a duty of care to persons who may be affected by roller shutters, doors or gate on their premises.
In the event of loss or injury caused by an unsafe gate or door, the injured party may be able to sue in a civil court to recover damages. Insurance cover is available fo rsuch risks, but may be prejudiced if the owner / manager has failed to maintain the roller shutter, door or gate to a reasonable standard
Duties of the Employers and the Self-Employed
Employers and the self-employed are additionally liable to criminal prosecutions under health and safety law if unsafe roller shutters, doors and gates exist on a premesis under their control;this could include landlords, managing agents and facilities managers.
These legislations are binding to the employer, or occupier of a building premises, who has a duty to safeguard he health and safety of all person on or about the premises:
Regulation 5 of the Workplace (Health Safety & Welfare) Regulations 1992
"The equipment devices and systems to which this regulation applies shall be subject to a suitable schedule of maintenance"
Regulation 5 of the Provision and Use of Work Equipment Regulations 1998
"Every employer shall ensure that work equipment is maintained in an efficient state, in efficient working order and good repair"
"Every employer shall ensure that where any machinery has a maintenance log, the log is kept up to date"
Regulatory Reform (Fire Safety) Order 2005
"Where necessary in order to safeguard the safety of relevant persons, the responsible person must ensure that the premises and any facilities, equipment and devices provided are subject to a suitable system of maintenance and are maintained in an efficient state and in efficient working order and good repair"
In order to satisfy the above regulations it is important that you can provide the following:
Kirk Craig Ltd. will work with you to ensure that your equipment is maintained to the best possible standard of compliance.
Once you take out a Service Contract with Kirk Craig Ltd. your site details and equipment will be logged onto our Service Inspection System.
Our Service Inspection Department will contact you to arrange a suitable date for engineers to attend, when it is most appropriate for you and your site, as Kirk Craig Ltd. understand that access is not always available.
Upon the first Service Inspection visit our engineers will number, and label the location of each roller shutter, to establish an ongoing log for each of your units. The identification numbers will be affixed on stickers which will also show the date of your last inspection. So you can quickly identify each unit and the date it was last inspected.
A tick sheet is produced for each unit, which will outline any issues of non compliance or recommendations. Works are split into two categories:
Safety Critical Works and Works Requiring Improvement.
Following completion of the Service Inspection our experienced engineers will explain any faults identified, and give you the opportunity to ask any questions.
The engineers will provide you with copies of the tick sheets, which will serve as evidence for the Planned Maintenance of your security equipment.
A detailed Service Inspection Report will be produced and sent to you following your Service Inspection. The Service Inspection Report will outline anything identified by the engineers, and costs to rectify.
